Darrell R. Atkinson

Darrell is experienced in both state and federal trial and appellate court practice.  His trial court experience includes extensive pre-suit due diligence, discovery, motion practice, and pre-trial work, in addition to witness examination and second and third trial chair experience.  Darrell’s appellate experience includes oral argument before the U.S. Court of Appeals for the Federal Circuit and the California Court of Appeals for the Second District.

Much of Darrell’s practice has been devoted to patent litigation where he has had ownership of various case aspects, including claim construction, damages, expert reports, pre-trial preparations, and appeals.  Darrell’s patent case appearances include matters before the Federal Circuit, the Northern District of California, the Western District of Texas, and the Southern District of New York.  Darrell’s patent practice extends beyond court and includes: portfolio and joint venture counseling; license negotiations and drafting; and arbitration representation.  Darrell has represented utility patent clients in a diverse range of technological fields, including internet predictive search, enterprise security, biotech, fintech, mobile payments, and stratospheric balloons.  In addition, Darrell has experience in furniture design patents.

Darrell also has extensive experience in litigating trade secret misappropriation and complex-technology contract cases, including experience in collaboration software, cryptocurrency, and medical device matters.

Darrell has represented clients in technology cases brought against some of the largest technology companies in the world, including Alphabet, Amazon, Cisco, Mastercard, and Meta.

Darrell’s experience also includes antitrust work, trademark matters, corporate governance and executive disputes, and residential real estate development litigation.

Education:

Darrell graduated with his J.D. from Stanford Law School, where he was a teaching assistant / research assistant for Professor Paul Goldstein for a then new copyright class and coeditor-in-chief of the Stanford Journal of Law, Science & Policy.

Prior to law school, Darrell completed an internship program in London where he was placed with an investment bank’s front office equities markets management team.

Darrell graduated magna cum laude from the University of Southern California with a bachelor of science in biochemistry, a minor in business, a Renaissance Scholar distinction, and admittances to the Phi Beta Kappa and Golden Key International honor societies.
